The legal Framework in India
Transplantation of Human Organs Act (THOA) 1994 was enacted to provide a system of removal, storage and transplantation of human organs for therapeutic purposes and for the prevention of commercial dealings in human organs. THOA is now adopted by all States except Andhra and J&K, who have their own similar laws. Under THOA, source of the organ may be:

Near Relative donor (mother, father, son, daughter, brother, sister, spouse)
Other than near relative donor: Such a donor can donate only out of affection and attachment or for any other special reason and that too with the approval of the authorisation committee.
Deceased donor, especially after Brain stem death e.g. a victim of road traffic accident etc. where the brain stem is dead and person cannot breathe on his own but can be maintained through ventilator, oxygen, fluids etc. to keep the heart and other organs working and functional. Other type of deceased donor could be donor after cardiac death.
Brain Stem death is recognized as a legal death in India under the Transplantation of Human Organs Act, like many other countries, which has revolutionized the concept of organ donation after death. After natural cardiac death only a few organs/tissues can be donated (like cornea, bone, skin and blood vessels) whereas after brain stem death almost 37 different organs and tissues can be donated including vital organs such as kidneys, heart, liver and lungs. WHAT IS KIDNEY TRANSPLANT?

A kidney transplant is a surgical procedure to place a kidney from a living or deceased donor into a person whose kidneys no longer function properly. If you are found to be healthy, and your antibodies and blood type are well-matched to the person getting your kidney, you may be approved to donate your kidney.

Kidneys are bean-shaped organs placed on either side of the spine just below the rib cage. The main function is to filter and remove excess waste, minerals and fluid from the blood by producing urine. Kidney transplant is done when the kidneys lose their ability to filter these wastes and thus leading to harmful levels of fluid and waste accumulating in the body. This could even raise blood pressure and ultimately result in kidney failure.

It is a surgical procedure that involves replacing a failed or poorly functioning kidney with a healthy kidney from a living or deceased donor. In comparison to the never-ending dialysis process, going for a kidney transplant seems like a better treatment choice for kidney failure.

Kidney failure is usually treated with dialysis. But a condition of acute kidney failure qualifies for a kidney transplant. In this process, one or both the kidneys are replaced with donated kidneys from a living donor or a deceased person. As per medical conditions and other factors, kidney transplants have their advantages and disadvantages.

Transplant candidates have two options for obtaining a new kidney: deceased or living donors. Most transplanted kidneys come from living donors. However, there are currently more people on the waiting list than there are available deceased donors. Living donation is a solution to this shortage, as transplant candidates may have willing living donors and not even know it.
